Disposable plastic objects are exempt if they are used as packaging .They are designed, sold or provided to hold food or drink on site or at the point of sale. What does it mean if a product is exempt « when it is used as packaging » ? Disposable cups, glasses and plates are not affected by this legislation as long as they are pre-filled with food or drink for the customer, as in this circumstance they are considered packaging by Directive 94/62/EC on packaging. However, it is affected by the legislation if it is provided unfilled or for use with food or drink supplied in another container which serves as packaging (for example, it is not permitted to provide an empty cup with a bottle or canned drink). What solutions to replace plastic disposable tableware ? Bio sourced materials : Tableware must comply with cumulative conditions : - The tableware must be at least 50% bio-sourced , as of 01/01/2020, 60% bio-sourced as of 01/01/2025. - The tableware must be compostable in home composting settings. Non-plastic materials : Products made of non-plastic materials, such as wood, bamboo, cardboard, paper and sugarcane pulp (bagasse), palm leaves and aluminium. What is domestic composting? Composting is a natural process that transforms organic material into an earthy product called humus or compost. Domestic composting can be done anywhere – including at home – unlike industrial composting, which takes place in composting facilities. What is a bio-sourced material? Bio-sourced materials are products made from renewable materials such as vegetal, animal, residual and agale (corn starch, potato starch).
